Terms of Service

1. Acceptance of Terms

By accessing or using DDSVPN, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2. Service Description

DDSVPN provides VPN tunnel management for dental practices using WireGuard protocol on UniFi Dream Machine firewalls. We provision tunnels, manage authentication, and provide administrative dashboards. We do not host, store, or process Protected Health Information (PHI).

3. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You must safeguard access to the email address associated with your account, as magic link authentication is sent via email.
  • You must notify us immediately of any unauthorized use of your account.
  • You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use DDSVPN to:

  • Engage in any illegal activities
  • Attempt to gain unauthorized access to networks, servers, or systems
  • Circumvent security controls or encryption
  • Access networks or data you are not authorized to access
  • Transmit malware, viruses, or other malicious code
  • Resell or redistribute DDSVPN services without a partner agreement

5. Intellectual Property

DDSVPN is owned and operated by THE DDS COMPANY. The DDSVPN name, logo, and web application are proprietary. The DDSVPN client application is based on WireGuard and is distributed under the MIT License.

6. Payment Terms

  • DDSVPN is billed monthly on a per-office basis.
  • Payment is processed via Stripe. We do not store credit card information.
  • Pricing is subject to change with 30 days notice via email.
  • No refunds for partial months of service.
  • Accounts with outstanding balances may be suspended after 14 days.

7. Service Availability

We target 99.9% uptime for the DDSVPN API and authentication services. VPN tunnel uptime depends on your office's internet connection, UniFi hardware health, and network configuration. We are not responsible for downtime caused by ISP outages, power failures, or hardware failures at your office.

8. Limitation of Liability

DDSVPN is a connectivity tool. We provide encrypted network access to your office infrastructure. We are not responsible for:

  • The software or data accessed through the tunnel
  • Patient Data security at your office
  • Compliance with dental practice regulations (your responsibility as a Covered Entity)
  • Hardware failures, internet outages, or network misconfigurations

To the maximum extent permitted by law, DDSVPN's total liability is limited to the amount you paid us in the past 12 months.

9. Termination

  • Either party may terminate this agreement with 30 days written notice.
  • We may terminate immediately if you violate the Acceptable Use Policy.
  • Upon termination, your access to DDSVPN will be revoked and your tunnels will be deprovisioned.
  • Account data will be deleted within 30 days unless you request an export.

10. Governing Law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in Greenville County, South Carolina, under the rules of the American Arbitration Association.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email. Continued use of DDSVPN after notification constitutes acceptance of the updated Terms.
